National regulations related to the Electronic Communications Act

In addition to the Electronic Communications Act, national regulations complement the Norwegian electronic communications framework, with the most central being: the Electronic Communications Regulation, the Data Center Regulation, the Numbering Regulation, and the Satellite Registration Regulation.

Purpose: The Electronic Communications Regulations supplement the Electronic Communications Act and support its objectives of ensuring that users in Norway have access to good, affordable, secure, and forward-looking communications services.

Scope: The Electronic Communications Regulation supplement several areas addressed by the Electronic Communications Act, such as security and preparedness, protection of communications, end-user rights, providers’ universal service obligations, network access, etc.

Purpose: The Data Center Regulation are intended to provide an overview of data centers and data center services through registration requirements as well as ensuring proper security and preparedness.

Scope: The Data Center Regulation apply to data center operators. Anyone providing access to data center services against payment or operating a data center with a subscribed electrical capacity above 0.5 MW, is considered a data center operator. The regulations focus heavily on security requirements for the construction and operation of data centers.

Purpose: The Numbering Regulations ensure the efficient and resource-efficient management of national numbering resources.

Scope: The Numbering Regulation apply to entities that apply for, are assigned, manage, or use Norwegian numbering resources. Numbering resources include, among other things, end-user telephone numbers, emergency and short numbers, and numbers for machine-to-machine communication.

Purpose: The Regulation on coordination and use of satellite filings ensure correct application and notification of satellite systems as well as their coordination towards the International Telecommunication Union (ITU).

Scope: Regulation on coordination and use of satellite filings – Frequency allocation for satellite use is a global matter, and frequency coordination is managed through an international body, ITU. In Norway, this responsibility rests with Nkom, as further set out in thus regulation. The regulation applies only to Norwegian legal entities, however several international operators have established Norwegian legal entities and applied for satellite notifications to ITU via Nkom (including SpaceX).
