In 2025, the International Court of Justice in The Hague (ICJ), the EFTA Court and the Inter-American Court of Human Rights issued groundbreaking court rulings on climate. Among other things, the ICJ noted that fossil fuel licenses, production or subsidies could be contrary to international law. Previously, the European Court of Human Rights (ECtHR) has ruled that fundamental human rights provide a right to protection against climate change, citing apex court decisions from the Netherlands and Germany. Meanwhile, apex courts in the UK and Norway have issued groundbreaking decisions on the need to assess climate impacts from new fossil fuel licensing. Our experts have handled several of these cases. What do these legal developments mean for the private sector?
